Fundamental rights and freedoms

The Spanish Constitution establishes a set of fundamental rights and freedoms which limit public authorities’ scope of power and define the aims and objectives that public policies and procedures must follow. Fundamental rights and freedoms have therefore an objective nature, in the sense that they define the political and legal structure, as well as a subjective nature since they grant individuals a specific legal status. The Spanish legal system provides legal protection of the referred rights through a specific procedure before the Constitutional Court.
