Liability of public authorities

According to the legal system in force, individuals have a right to receive compensation for any damage that their goods or rights might suffer as a result of the normal functioning of public services, except in cases of force majeure.

The increasing range of activities conducted on behalf of Public Authorities has generated a gradual increase in the number of proceedings concerning accountability of the Administration. These proceedings are addressed at the identification of existing damages and the assessment of compensations. Since the expansion of Administrative Courts’ Jurisdiction, the referred proceedings are no longer covered by Labour or Civil Courts, instead, they fall under the competency of Administrative Courts.
